This session will take place Saturday, November 12th, 2022.

Locations:
The area behind my home on 3710 Magnolia Ridge in League City. You will walk through the empty lot between 3706 and 3702 Magnolia Ridge and will me. Please plan enough time to walk back to the location. It's probably 1/10 -1/25 mile walk. Please be careful when driving through our neighborhood. All our children are always out playing. :)

I recommend bringing bug spray and a towel for the morning dew.

Please read all details in the contract BEFORE purchasing.

It is understood that Ashley Gilfoil, with Shutterluv by Ashley, is the exclusive official photographer retained to perform the photographic services requested on this Contract.

Arrival Time

The client agrees to arrive FULLY prepared for the photo session at the agreed upon time for the session. Late arrivals will result in a loss of time for the session and a reduction in the number of delivered images.

Payment Policy

Upon the receipt of a $50 nonrefundable retainer fee, the photographer shall reserve the agreed upon time and date for the photo session. The remaining balance is due at upon the completion of the session. No images, including previews, will be delivered until the balance is paid in full.

The cost of the session includes only the images the photographer determines to meet her artistic standard in the form of edited JPEG files. Client will receive ALL edited JPEG files of only the images the photographer determines meets her artistic standard.

The charges in this Contract are based on the Studio’s/Photographer’s Standard Price List found on the website. This price list is adjusted periodically and future sessions shall be charged at the prices in effect at the time when the session is booked.

Weather Policy

If, in the opinion of the photographer, inclement weather or other adverse conditions prevent the creation of a session meeting the artistic standards of the photographer, the photographer may elect to use an alternate location or to reschedule the session.

Refund Policy

All retainers are nonrefundable, even if the session is rescheduled or canceled for any reason other than illness or inclement weather. If the session is rescheduled due to illness, the client may apply the retainer to ONE future session date. If any additional changes in dates are made, a new retainer fee will be required.

Photography is art and art is subjective. If the Photographer produces services that are in the same style and structure as the Photographer’s past work, by reference of the Photographer’s portfolio, the Client is deemed to have accepted the Photographer’s artistic interpretation.

Where services provided are not of an acceptable technical quality such as proper focus or proper lighting, the Photographer has the right to rectify the defect causing the rejection within a reasonable time.

If rectified, the Photographer is entitled to their fee and services related expenses but may not charge the client an extra fee or cost for rectifying the defect. If the photographer is unable to rectify the defect within a reasonable time, no fees are due to the photographer.

Limitation of Liability

If the Studio/Photographer cannot perform this Contract due to fire or other casualty, strike, act of God, or other cause beyond the control of the parties, or due to Photographer’s illness or emergency, then the Photographer shall return any deposit or sitting fee to the Client but shall have no further liability with respect to the Contract.

This limitation on liability shall apply in the event that photographic materials are damaged in processing, lost through camera or media malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of the Photographer. In the event the Studio/Photographer fails to perform for any other reason, the Studio/Photographer shall not be liable for any amount in excess of all monies paid.

While every reasonable effort will be made to produce and deliver outstanding photographs from the session, The Photographer(s)’ entire liability to The Client for any claim or loss arising from The Photographer(s)’ performance is limited to a refund to The Client of the amount paid for services.

The Photographer(s) cannot guarantee delivery of any specifically requested image(s) except for images made under such conditions that The Photographer has complete control over all variables which contribute to the production of an image, including but not limited to, lighting, time, subject position and distance to camera.

Additionally, The Photographer(s) cannot be responsible for the effects of the subjects’ temperament, physical appearance, including body position, facial expressions, blinking or clothing. The Photographer(s) cannot be responsible for the effects of environmental conditions, including, but not limited to, weather conditions, temperature, existing lighting or aesthetics of the shoot location.

The Photographer has the right to refuse to produce any image that could violate libel or copyright laws, or in the course of its production could cause or contribute to bodily injury, death, equipment damage or property damage or destruction.

Model Release

The /Photographer reserves the right to use images created under this contract for advertising, display, publication or other purposes.

The Client signing this contract warrants that he or she has actual authority to agree to the use of the likeness of all persons included in the portrait in this manner and shall indemnify and defend the Studio/Photographer in the event of litigation arising out of such use. Negatives, digital files and previews remain the exclusive property of this Studio/Photographer.

Photographic Prints

Client is aware that failure to print through non-recommended print labs may result in a lesser quality print.

NOTICE OF COPYRIGHT

It is ILLEGAL to copy or reproduce these photographs or videos commercially without the Studio’s/Photographer’s permission, and violators of this Federal Law will be subject to its civil and criminal penalties. Photographs are limited reproduction for personal use and include a print release, found in the image Gallery.

COVID 19 WAIVER

Client and members of Client’s party assume all risks associated with potential COVID-19 transmission or exposure in relation to the photography services being provided and accept sole responsibility for an illness, injury, damages, claims or expense arising therefrom regardless of the identity of the person alleged to be at fault for such transmission or exposure.

As consideration for this waiver, Studio agrees to waive any liability or claim against Client or members of Client’s party for COVID-19 transmission or exposure.

• This Contract incorporates the entire understanding of the parties and is governed by the laws of League City, Galveston County, Texas. Any modifications of this Contract must be in writing and signed by both parties.
